Analysis Health – Terms of Service

These Terms of Service (“Terms”) constitute a binding legal agreement between you (“User,” “you,” or “your”) and Analysis Health (“Company,” “we,” “us,” or “our”). By accessing our website, purchasing an Insight Report, or using our AI-driven platform, you agree to be bound by these Terms.


1. Eligibility & User Account

  • Self-Use Only: You may only use this service for yourself. You are strictly prohibited from uploading data or purchasing reports for any third party.

  • Age Requirement: You must be at least 18 years of age to use the service.

  • Account Security: You are responsible for maintaining the confidentiality of your login credentials. Analysis Health is not liable for any loss resulting from unauthorized access to your account.

2. AI-Driven Decision Support (Non-Medical Service)

  • Nature of Service: Analysis Health provides a technology-based health interpretation tool. It is not a medical provider and does not provide medical advice, diagnosis, or treatment.

  • AI Disclosure: You acknowledge that all reports are generated by an automated Artificial Intelligence pipeline. In accordance with the Colorado AI Act, we disclose that you are interacting with a synthetic system that may produce inaccurate or biased outputs.

  • Anti-Reliance: The findings provided are for educational purposes only. You agree that you will not start, stop, or modify any medical treatment or prescription medication based on our reports without direct consultation with a licensed human physician.

3. Data Rights & AI Processing License

  • Ownership: You retain all rights to your raw health data and laboratory results.

  • Processing License: You grant Analysis Health a limited, worldwide, royalty-free license to process your data solely for the purpose of generating your report and performing internal quality control.

  • Zero Data Retention (ZDR): We utilize AI vendors that adhere to ZDR protocols. Your data will not be used to "train" global third-party AI models.

4. Payments, Affiliates, & Refund Policy

  • Refund Policy: Due to the immediate provisioning of our AI pipeline, all sales are final. No refunds will be issued after the point of purchase, regardless of whether you complete the intake questionnaire or upload your data.

  • Affiliate Disclosure: Our reports contain links to third-party supplements or lab tests. We may earn a commission on purchases made via these links. Analysis Health is not responsible for the quality, safety, or efficacy of these third-party products.

5. Mandatory Arbitration & Mass Arbitration

  • Individual Arbitration: Any dispute arising from these Terms will be resolved through individual, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Governing Law: These Terms are governed by the laws of the State of Colorado.

  • Mass Arbitration Batching: If 25 or more similar arbitration demands are filed against us within a 90-day period, you agree to a "batching" process where claims are resolved in groups of 10 to ensure efficiency and reduce procedural costs.

  • Class Action Waiver: You expressly waive your right to participate in any class-action lawsuit or class-wide arbitration.

6. Limitation of Liability

To the maximum extent permitted by law, Analysis Health’s total liability for any claim arising from the service—including AI inaccuracies or data errors—is limited to the total amount paid by you for the service in the twelve (12) months preceding the claim.
